1. Information We Collect

Depending on how you interact with the Services, we may collect:

• Contact and business information: name, business email address, telephone number, company, job title, and the contents of inquiries or support requests.
• Account information: username, account identifiers, authentication information, role, permissions, organization, and account preferences.
• Customer content: information submitted to the platform by customers and authorized users, such as prospect and customer records, contact details, equipment records, pricing, proposals, contracts, sales activity, commissions, lease and renewal information, tasks, notes, reports, and related business records.
• Transaction and subscription information: plan, order, invoice, payment status, and billing contact information. Payment card data, if collected, should be processed by our payment provider rather than stored by AiXGEN.
• Technical and usage information: IP address, browser and device information, operating system, pages or features used, dates and times of access, referring URLs, diagnostic data, security events, and activity logs.
• Integration information: information exchanged when a customer connects an approved third-party service, subject to the customer's configuration and the third party's terms.
• Communications: messages, feedback, survey responses, demo requests, and records of support or sales communications.

Please do not submit Social Security numbers, government identification numbers, health information, payment card security codes, or other highly sensitive information unless AiXGEN has expressly agreed in writing to process that information.

2. Sources of Information

We may collect personal information:

• directly from you;
• from your employer or the organization that provides your account;
• from customer-authorized integrations;
• automatically through the Services and their security logs; and
• from service providers, business partners, and publicly available business sources where permitted by law.

3. How We Use Information

We may use personal information to:

• provide, operate, maintain, and secure the Services;
• create and administer accounts, roles, permissions, and integrations;
• process requests, subscriptions, invoices, and customer support;
• configure and improve workflows, reporting, product performance, and usability;
• communicate about demos, service updates, security matters, and relevant product information;
• detect, investigate, and prevent fraud, misuse, unauthorized access, and security incidents;
• monitor performance, troubleshoot problems, and maintain audit and activity records;
• enforce agreements and protect our rights, customers, users, and the public; and
• comply with law, legal process, and regulatory obligations.

Where required, we rely on consent, performance of a contract, compliance with legal obligations, or our legitimate business interests as the legal basis for processing.

4. How We Disclose Information

We may disclose personal information to:

• Customer administrators: the organization that controls your AiXGEN account and its authorized administrators.
• Service providers: vendors that support hosting, infrastructure, security, authentication, communications, customer support, analytics, payment processing, and professional services. They may process information only for contracted purposes and subject to appropriate obligations.
• Integrations: third-party services connected or enabled by a customer or authorized user.
• Professional advisers: attorneys, accountants, auditors, insurers, and consultants where reasonably necessary.
• Authorities and other parties: when required by law or when reasonably necessary to protect rights, safety, security, and the integrity of the Services.
• Corporate transaction participants: parties involved in a merger, financing, acquisition, reorganization, bankruptcy, or transfer of all or part of our business, subject to appropriate safeguards.

AiXGEN does not sell personal information for money. AiXGEN does not share personal information for cross-context behavioral advertising and does not use sensitive personal information to infer characteristics about individuals. If these practices change, we will update this Policy and provide any legally required choices before the change takes effect.

5. Customer-Controlled Data

Customers determine what information they submit to the platform, who may access it, and how it is used. Customers are responsible for providing required notices, obtaining required permissions, configuring access appropriately, and responding to requests concerning customer-controlled data. AiXGEN processes that data to provide the Services, follow documented customer instructions, maintain security, and meet legal obligations.

Enterprise customers may enter into a separate data processing addendum with AiXGEN. If a customer agreement conflicts with this Policy regarding customer-controlled data, the customer agreement controls to the extent of the conflict.

6. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, maintain the customer relationship, satisfy contractual and legal obligations, resolve disputes, enforce agreements, and protect the Services. Retention periods depend on the type of information, customer instructions, account status, legal requirements, security needs, and whether information is contained in backups. We may retain deidentified or aggregated information where it cannot reasonably be linked to an individual.

7. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. These measures may include access controls, role-based permissions, authentication, logging, encryption in transit, secure hosting practices, monitoring, and incident response procedures. No system is completely secure, and we cannot guarantee that unauthorized access or loss will never occur.

You are responsible for protecting account credentials, using appropriate access settings, and promptly notifying us of suspected unauthorized activity.

8. Cookies and Similar Technologies

We may use cookies and similar technologies for essential site operation, authentication, security, preferences, and, where enabled, measurement or analytics. Our Cookie Policy provides more detail. Where consent is legally required for nonessential cookies, we will request it before using those cookies.

9. Your Choices and Rights

Depending on your location and applicable law, you may have the right to request access to, correction of, deletion of, or a copy of your personal information, or to object to or restrict certain processing. You may also withdraw consent where processing is based on consent.

To submit a request, email support@aixgenstudio.com with the subject line Privacy Request. Describe your request and identify the account or organization involved. We may need to verify your identity and authority before responding. Authorized agents may submit requests where permitted by law, subject to verification of their authority.

If your information is controlled by an AiXGEN customer, we may direct your request to that customer or assist the customer in responding. We will not discriminate against you for exercising applicable privacy rights.

You may unsubscribe from promotional emails through the link in the message or by contacting us. Service and security communications may still be sent when necessary.

10. California Privacy Notice

This section applies to California residents where the California Consumer Privacy Act, as amended ("CCPA"), applies to AiXGEN's processing.

During the preceding 12 months, we may have collected the following CCPA categories: identifiers; customer-record information; commercial information; internet or electronic network activity; professional or employment-related information; approximate geolocation derived from IP address; and inferences related to business use of the Services. Account login credentials may qualify as sensitive personal information. We collect these categories from the sources described in Section 2 and use them for the purposes described in Section 3.

We may disclose these categories for business purposes to the recipients described in Section 4. We do not sell these categories or share them for cross-context behavioral advertising. We do not knowingly sell or share personal information of individuals under 16.

Subject to applicable exceptions, California residents may request that we:

• disclose the categories and specific pieces of personal information we maintain;
• disclose categories of sources, purposes, and recipients;
• delete personal information;
• correct inaccurate personal information;
• provide personal information in a portable format; and
• honor applicable rights concerning sale, sharing, and sensitive personal information.

Requests may be submitted through support@aixgenstudio.com. If AiXGEN becomes subject to a legal requirement to provide an additional request method, that method will be identified here. We will confirm and respond to verified requests within the periods required by law.

11. Browser Privacy Signals

AiXGEN does not currently engage in cross-context behavioral advertising or sell or share personal information as those terms are defined by the CCPA. Where legally required and technically applicable, we will treat a recognized Global Privacy Control signal as a request to opt out. Because there is not yet a uniform standard for other browser "Do Not Track" signals, the Services may not respond to those signals. Third parties may collect information over time and across services only when their technologies or integrations are enabled as described in this Policy and the Cookie Policy.

12. Children's Privacy

The Services are designed for businesses and are not directed to children under 18. We do not knowingly collect personal information from children under 13. If you believe a child has provided personal information to us, contact us so we can investigate and take appropriate action.

13. International Use

AiXGEN is based in California, United States. Information may be processed in the United States and other locations where AiXGEN or its service providers operate. Where required, we use appropriate contractual or legal safeguards for cross-border transfers.

14. Third-Party Services

The Services may link to or integrate with third-party services. Their privacy practices are governed by their own policies. AiXGEN is not responsible for third-party services that it does not control.

15. Changes to This Policy

We may update this Policy to reflect changes in the Services, law, or our practices. We will post the revised Policy with a new "Last updated" date and provide additional notice when required. Material changes apply prospectively unless otherwise permitted by law.
